These terms apply to products purchased from PEDL using a preorder, reservation or deposit payment option.
1. Deposit
Where a deposit option is offered, the customer may secure the product by paying the deposit amount displayed at checkout, generally 20% of the purchase price.
The remaining balance must be paid before the product is collected, delivered or dispatched.
2. Preorder Confirmation
Payment of a deposit reserves the customer's order for the selected product, model, size, colour or variant, subject to availability and these terms.
A preorder does not mean that the product is currently physically held by PEDL unless specifically stated.
3. Estimated Arrival and Delivery Dates
Any estimated arrival, availability or delivery date provided for a preorder is an estimate unless PEDL expressly confirms that the date is guaranteed.
Preorder products may be affected by circumstances outside PEDL's direct control, including manufacturing schedules, supplier allocations, international freight, customs clearance, port congestion and other logistics delays.
PEDL will provide reasonable updates when we become aware of material changes to an estimated arrival timeframe.
4. Customer Change of Mind
Where PEDL remains able to supply the product in accordance with the preorder and within the represented or agreed timeframe, deposits are non-refundable for change of mind, subject to the customer's rights under the Australian Consumer Law.
This includes circumstances where the customer simply decides they no longer want the product, purchases another product elsewhere or their personal circumstances change.
5. Delayed Preorders
If a preorder experiences a material delay beyond the estimated delivery timeframe provided when the order was placed, PEDL will provide the customer with an updated estimated timeframe where reasonably available.
Where the delay is material, the customer may choose to:
- continue with the preorder and retain their allocation;
- transfer amounts paid to another available product; or
- cancel the preorder and receive a refund of amounts paid.
6. PEDL Unable to Supply
If PEDL is unable to supply the product ordered, the customer may choose between a refund of amounts paid or transferring those amounts to another product.
PEDL will not retain a deposit for a product that PEDL is unable to supply where the customer is entitled to a refund under Australian Consumer Law.
7. Confirmed Preorder Prices
Where a product is advertised with a confirmed preorder price, that price is locked when PEDL accepts the customer's preorder and deposit.
If the retail price subsequently increases, the customer will continue to receive the product at the confirmed preorder price.
8. Estimated or Provisional Prices
Some products may be offered for preorder before the final Australian retail price has been confirmed.
Where this applies, the product will be identified as having an estimated, indicative or provisional price.
If the final price is higher than the estimated price, PEDL will advise the customer before requiring payment of the remaining balance.
The customer may then either proceed at the confirmed final price or cancel the preorder and receive a refund of amounts paid.
9. Manufacturer Changes
Products offered before their final production release may be subject to manufacturer changes.
This can include reasonable changes to specifications, components, colours, accessories, software, appearance or other product features.
If PEDL becomes aware of a material change to the product that significantly affects what the customer ordered, PEDL will notify the customer and provide any options required under Australian Consumer Law.
10. Balance Payment
PEDL will contact the customer when the product is approaching availability or is ready for collection or dispatch.
The outstanding balance must be paid before the product is released, collected, delivered or dispatched.
Where requested, the customer must pay the balance within the timeframe specified by PEDL.
11. Failure to Pay the Balance
If the customer does not pay the outstanding balance within the requested timeframe, PEDL may contact the customer and provide a reasonable opportunity to complete the purchase.
If the customer subsequently confirms that they no longer wish to proceed, this may be treated as a change of mind and the change-of-mind provisions in these terms will apply, subject always to Australian Consumer Law.
12. Allocation and Availability
Preorder quantities and supplier allocations may be limited.
Payment of a deposit secures the customer's position against PEDL's expected allocation but does not guarantee that a manufacturer or supplier will fulfil its allocation to PEDL.
If PEDL's allocation is reduced or cancelled and PEDL consequently cannot supply the customer's product, the customer may choose to wait for the next available allocation, transfer the amount paid to another product, or receive a refund.
13. Cancellation by PEDL
PEDL may cancel a preorder where the product is discontinued, unavailable, incorrectly listed, affected by a genuine pricing error, or PEDL is otherwise unable to fulfil the order.
Where PEDL cancels a preorder, amounts paid by the customer will be refunded unless the customer agrees to transfer those amounts to another product.
14. Refunds
Where a customer is entitled to a refund under these terms or Australian Consumer Law, PEDL will process the refund using the original payment method where reasonably possible.
Banking and payment-provider processing times may apply after PEDL processes the refund.
15. Australian Consumer Law
These terms do not exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Where these terms are inconsistent with a right or remedy available to a customer under Australian Consumer Law, the Australian Consumer Law will apply.
